Producing, filing and Serving your Judgment Debtor Examination

Another tool in collecting your judgment is the Judgment Debtor Examination. This “Application and Order to Produce Statement of Assets and to Appear for Examination” and “Judgment Debtor's Statement of Assets” are served on your judgment debtor. The judgment debtor is ordered to appear in court and answer questions regarding his/her assets. Because these documents are an Order of the court, they require personal service upon the Judgment Debtor.

If the judgment debtor fails to appear at this hearing, a Bench Warrant may be issued.

• File the Judgment Debtor Examination documents in the court in which the underlying case was heard. After the documents have been filed and issued a court date, our associates will e-mail or fax you a copy.

• Serve the Judgment Debtor(s) and file the Proof of Service(s).
